1. Scope

1.1.These General Terms and Conditions (Terms) govern the booking and delivery of the retreat “Qigong Reset” from 22 to 28 March 2027 at Finca Son Salas, Sóller, Mallorca (the “Retreat”) by Felix Kassem Mreiche, trading as Bon Sentiment (the “Organiser”).

1.2.The Organiser arranges and delivers the Retreat in its own name, composing accommodation, meals and the programme as set out in clause 4. Travel to and from Mallorca, travel insurance and any service not listed in clause 4 are not part of the contract.

1.3.Teaching is provided by Stephane Kamesh. The Organiser is the participant’s contractual partner; the teacher is not.

2. Booking and Formation of Contract

2.1.The description of the Retreat on bon-sentiment.com/qi-gong and in the Organiser’s materials is an invitation to book, not a binding offer.

2.2.Participants book in writing (e-mail or reservation form), stating name, address, e-mail, telephone, preferred room category and occupancy. The contract is formed when the Organiser confirms the booking in writing.

2.3.With the confirmation, participants receive the invoice for the deposit and these Terms. Booking is subject to acceptance of these Terms.

2.4.Rooms are allocated by category, booking order and the composition of the group. The Organiser will try to accommodate preferences without guaranteeing them.

3. Price and Payment

3.1.The prices communicated at the time of booking apply, per person by room category and occupancy. All prices are final prices in euros and include Spanish VAT (IVA).

3.2.Payment in two instalments by bank transfer: a deposit of 30 % of the total price within 7 days of confirmation; the balance 8 weeks before arrival, i.e. by 25 January 2027 at the latest. For bookings made after 25 January 2027, the total price is due within 7 days of confirmation.

3.3.The place is firmly reserved on receipt of the deposit. If an instalment is not received despite a reminder and a 7-day grace period, the Organiser may withdraw from the contract and reallocate the place; the cancellation terms in clause 6 apply accordingly.

3.4.Bank charges are borne by the paying party. Card payment is available on request.

4. Services Included

4.1.The price includes: six nights at Finca Son Salas (arrival 22 March from 3 pm, departure 28 March by 11 am) in the booked category and occupancy; breakfast from 23 to 27 March and a light departure breakfast on 28 March; lunch and dinner on the five practice days; the Qigong programme with Stephane Kamesh over five days; use of the practice room, pool, gym and tennis court in accordance with the house rules; the Balearic tourist tax.

4.2.Not included: flights and travel to Mallorca, airport transfers (bookable through the Organiser at €70 each way), travel, cancellation and health insurance, drinks outside meals, personal expenses, treatments and laundry.

4.3.The Organiser may adjust the schedule and content of the programme provided the aim and overall character of the Retreat are preserved. Should the announced teacher be prevented at short notice, the Organiser may provide an equally qualified teacher; this does not entitle participants to withdraw.

4.4.Late arrival, early departure or unused services do not give rise to any refund.

5. Minimum Number of Participants and Cancellation by the Organiser

5.1.The Retreat runs with a minimum of twelve paying participants. If this number is not reached, the Organiser may cancel the Retreat up to 21 December 2026. Participants will be informed in writing without delay, and all payments made to the Organiser will be refunded in full within 14 days.

5.2.The Organiser will confirm in writing that the Retreat is going ahead by 22 December 2026 at the latest. Participants are advised to book flights only after this confirmation or on flexible fares. Travel costs and other expenses are not reimbursed in the event of a cancellation under clause 5.1.

5.3.If delivery becomes impossible or seriously jeopardised by circumstances beyond the Organiser’s control (in particular force majeure, official orders, unavailability of the finca or the teacher with no substitute), the Organiser may cancel or postpone the Retreat. In case of cancellation, all payments made to the Organiser are refunded; no further claims arise, to the extent permitted by law.

6. Cancellation by Participants, Changes, Substitutes

6.1.Participants may cancel in writing at any time before the Retreat begins. The date of receipt by the Organiser is decisive.

6.2.On cancellation, a flat-rate compensation is due, reflecting the costs the Organiser has by then incurred with the finca, the teacher and suppliers: from booking until 25 January 2027 (8 weeks or more before arrival) 30 % of the total price; from 26 January to 7 February 2027 (56 to 43 days before arrival) 50 %; from 8 to 21 February 2027 (42 to 29 days before arrival) 75 %; from 22 February 2027 (28 days or less before arrival) and in case of no-show 100 % of the total price.

6.3.Participants may demonstrate that the Organiser has suffered no loss or a substantially smaller one. If the place can be resold to another person, the compensation is reduced accordingly.

6.4.The cancellation terms apply regardless of the reason for cancellation, including illness, accident, professional or personal reasons. Taking out cancellation insurance is expressly recommended.

6.5.Instead of cancelling, a substitute may be named who enters into the contract and meets the participation requirements. A handling fee of €150 applies. The Organiser may object to the substitute on reasonable grounds.

7. No Right of Withdrawal

7.1.The contract concerns accommodation and leisure services for a specific date. Under Article 103(l) of the Spanish Consumer Protection Act (Real Decreto Legislativo 1/2007, TRLGDCU), there is therefore no statutory 14-day right of withdrawal. The cancellation terms in clause 6 apply.

8. Participation Requirements and Health

8.1.The Retreat is for adults. Qigong is a gentle, standing movement practice; no particular fitness is required. Participation is at the participant’s own responsibility.

8.2.Participants inform the Organiser before the Retreat of any health conditions, pregnancy, allergies or intolerances relevant to the practice or to meals. In case of doubt, medical advice should be sought beforehand.

8.3.The Retreat is not a medical, therapeutic or psychological treatment and does not replace one. Neither the teacher nor the Organiser makes any promise of healing.

8.4.Participants observe the house rules of Finca Son Salas and the instructions of the Organiser and the teacher. In case of serious disruption of the Retreat, the Organiser may exclude a participant; no refund is made in that case.

9. Liability

9.1.The Organiser is liable under statutory provisions for damage arising from injury to life, body or health and for intent and gross negligence. Otherwise, liability is limited to foreseeable damage typical of the contract, to the extent permitted by law.

9.2.The Organiser is not liable for services booked by participants themselves from third parties (in particular flights, hire cars, insurance), nor for loss of personal belongings.

9.3.Participants are liable to the Organiser for damage to the finca and its furnishings culpably caused by them; the Organiser represents them towards the owner.

10. Photography and Recordings

10.1.The Organiser may arrange for photographs and video to be taken during the Retreat for documentation and for its own communications (website, newsletter, social media).

10.2.Recordings in which participants are recognisable are used only with their separate, voluntary consent, given at booking and revocable at any time — including on site towards the person recording. Revocation has no effect on participation.

11. Data Protection

11.1.The Organiser processes participants’ personal data to perform the contract in accordance with the GDPR and Spanish data protection law (LOPDGDD). Name, address and ID details are passed to Finca Son Salas to the extent required by Spain’s statutory traveller registration. Health information under clause 8.2 is used solely for delivery of the Retreat and deleted afterwards. Details are set out in the privacy policy on bon-sentiment.com.

12. Governing Law and Jurisdiction

12.1.Spanish law applies. Mandatory consumer-protection provisions of the state in which a consumer is habitually resident remain unaffected.

12.2.For consumers, the statutory courts have jurisdiction. For participants booking as businesses, the courts of Palma de Mallorca have jurisdiction.

13. Final Provisions

13.1.Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions is unaffected. The statutory provision replaces the invalid one.

13.2.These Terms are available in English and German. In case of discrepancies, the English version prevails.

13.3.Amendments and side agreements must be made in writing; e-mail suffices.
